This is a translation. In case of doubt, the German version prevails.

This website is operated by Jenny Halfina, B.Sc. The words "we", "us" and "our" refer to Jenny Halfina, B.Sc. and to MaxOut.

By visiting this website, booking a class or purchasing a service, you agree to these terms. They apply to everyone using the site and to everyone booking our services.

We may change these terms. The current version is always on this page.

1. Online bookings and use

Our services consist of workouts, classes, training sessions, single tickets and multi-session passes.

Bookings are made online through this website or the booking system provided. Complete and accurate details are required.

You agree to use our services lawfully and appropriately. Misuse of the website, the booking system or our services is not permitted.

2. Services, prices and payment

All prices are shown on the website or in the booking system. Prices are subject to change.

Payment is made through the methods offered. A booking becomes binding only once payment has succeeded or we have confirmed it.

We may change, postpone or discontinue classes, prices, dates or services where necessary.

3. Cancellation by you

A booked class can be cancelled free of charge up to 12 hours before it starts. The session is then credited back to your account automatically.

Cancellations made less than 12 hours before the start cannot be accepted. In that case there is no entitlement to a refund, a replacement date or a credit, including in cases of short-notice illness, personal circumstances or non-attendance.

We may still make a goodwill decision in individual cases.

4. Cancellation by us

We may cancel or postpone classes for good reason, in particular illness, poor weather, safety concerns, too few participants or other unforeseeable circumstances.

If we cancel a class, the session is credited back to your account automatically. There is no entitlement to compensation beyond that.

5. Passes, single tickets and credits

A single ticket entitles you to attend one booked class.

Multi-session passes can be used for several classes. Unused sessions remain in your account unless a different validity period is stated.

Multi-session passes are generally not refundable. A session booked from a pass is credited back only if cancelled at least 12 hours before the class starts. Later cancellation, short-notice illness or non-attendance forfeits the session.

Passes and credits are personal and non-transferable.

6. Right of withdrawal and refunds

For online purchases, consumers generally have a statutory right of withdrawal of 14 days from conclusion of the contract, unless a statutory exception applies.

If services have already been used within that period, a proportionate amount may be retained for what has been provided. Once the booked service has been fully provided there is no entitlement to a refund, as far as the law permits.

Statutory exceptions to the right of withdrawal remain unaffected, in particular for services tied to a specific date or period.

7. Health and participation

Participation in our classes is at your own responsibility.

You confirm that you are in a fit state of health to take part. In case of health complaints, injury, pregnancy or uncertainty, please seek medical advice before participating.

We accept no liability for health damage arising from misjudging your own condition, pre-existing conditions or incorrect execution, as far as the law permits.

8. Liability

We take care to provide our services diligently and professionally.

Liability for slight negligence, indirect damage, lost profit or consequential loss is excluded as far as the law permits.

We accept no liability for personal belongings, valuables or items brought with you.

9. Information on the website

We aim to keep all information current and correct. Errors, changes and inaccuracies can nevertheless occur.

We may change content, prices, class times and offers at any time.

10. Third parties and booking systems

Our website and booking system use third-party services, in particular Eversports for booking and payment and Google Maps for the map on the contact page.

We accept no responsibility for the content, technical availability or performance of those third parties, as far as the law permits.

11. Personal data

Personal data is processed in accordance with our privacy policy.

You agree to provide complete and accurate details when booking and paying.

12. Prohibited use

Using our website or services for unlawful purposes, abusive bookings, false information, technical attacks, spam, fraud or infringing third-party rights is prohibited.

In case of breach we may refuse bookings, suspend accounts or terminate use of our services.

13. Severability

If any provision of these terms is wholly or partly invalid, the validity of the remaining provisions is unaffected.

14. Governing law

The law of the Republic of Austria applies.
